Individual Claims

To the extent permitted by applicable law, you and WESTBAY SERIES LLC agree to pursue claims individually rather than as part of a class, consolidated, or representative proceeding.

Where a dispute is subject to a valid, separately applicable arbitration agreement, claims may not be consolidated without the parties’ written agreement.

Questions concerning the enforceability of this class action waiver will be determined by a court of competent jurisdiction. This provision does not restrict rights that cannot legally be waived.
